Step 2: Mediation
If informal negotiation fails, both parties agree to participate in mediation conducted by a mutually agreed-upon neutral mediator before pursuing litigation.
Step 3: Formal Proceedings
Only after exhausting informal negotiation and mediation may either party proceed with formal legal action in the designated jurisdiction.
Class Action Waiver
To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive the right to participate in any class action or class-wide dispute resolution.
Severability Clause
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, such provision shall be severed from these terms. The remaining provisions shall continue in full force and effect.
